Salustri Photography Terms & Conditions

EFFECTIVE 25 November 2017

Please read carefully

1. Introduction

1.1 In the following terms & conditions “the photographer” shall mean Paola Salustri, trading as Salustri Photography. “The client(s)” shall be the person(s) to be photographed, or parent(s)/guardian(s) responsible for the photoshoot booking. By placing a booking with the photographer, you agree to the following Terms and Conditions.

2. Session Fee/Package Fees

2.1. Session fees or mini session packages must be paid for in full before the photoshoot commences. Bookings and payments are taken via www.salustri.co.uk

2.2. The cost of booking a photoshoot, either paying for the photographer’s session fee or by purchasing any seasonal mini session package, is non-refundable.

3. Prices

3.1. All packages and additional products are supplied at the prices stated at the time of booking. Any voucher codes must be submitted at the time of booking for the discount to be applied.

3.2. For all photoshoots, client(s) agree to purchase one of the packages listed on the photographer’s website. Individual items are not available to purchase unless a print or canvas package has already been purchased.

4. Photo Consent

4.1. The client(s) may choose to provide photo consent to allow the photographer to display any image covered by this contract and to feature images in various forms of publicity, such as advertising, magazine articles, websites, sample prints, etc. Parent(s)/guardian(s) provide photo consent for any images of children under the age of 18 to be:
• displayed on the company website, www.salustri.co.uk
• featured within Salustri Photography business correspondence
• featured on the business Facebook page (@salustriphotography) and other social media pages for Salustri Photography, such as Instagram
• entered for photographic competitions
• used for marketing purposes for Salustri Photography, such as promotions and competitions
• featured in publications such as books or magazines

4.2. Salustri Photography will take all steps to ensure that these images are used solely for the purposes they are intended. To deter any unauthorised usage, all images will be sized small and those for social media will feature a watermark. Images are not able to be copied via the website.

4.3. Salustri Photography will also ensure that no images are sold for advertising outside of Salustri Photography or put up for sale within any photographic agencies.

5. Artistic license

5.1. Photographs taken during the photoshoot will be at the discretion of the photographer. If you have any specific shots in mind these should be communicated prior to the shoot date. Every effort will be made to comply with the client’s requirements.

5.2. Similarly, the photographer is granted artistic license in relation to the poses photographed and the locations used. The photographer aims to provide a full range of poses, but sometimes children/people are not always fully cooperative. The photographer will work hard to make all family members feel comfortable in front of the camera, but some children/people can be painfully camera shy. In these cases, the aim will be to get candid shots instead of trying to get a smile into camera.

6. Safety on location and at home

6.1. On location and at home photoshoots, creative lighting may be used involving equipment such as a lighting stands and softboxes. The photographer will use safety weights to prevent these items falling over and will issue safety advice. Parents/guardians must take notice of verbal safety instructions issued by the photographer. It is parents who remain responsible for the safety of their child/children under the guidance of safety instructions.

6.2. For baby and toddler photoshoots, a parent/guardian MUST be present at all times in order to spot the baby while being photographed. This means that a parent/guardian will be within arm’s reach AT ALL TIMES. You may be given instructions to support baby to ensure safety.

6.3. For baby photoshoots at the client(s) home, parents/guardians should ensure pets and older siblings remain outside of the room while individual photographs are taken of the baby. They must not be allowed to run around at this time as there will be stands and equipment they can trip over.

7. Technical failure

7.1 Although steps are taken to ensure equipment is fully functional, the photographer will not be held responsible for technical failure. In this scenario, the client(s) will be offered a replacement photoshoot.

8. Cropping ratio for prints and products

8.1 The photographer mostly uses the aspect ratio of 2:3 which is ideal for most professional print sizes. Images are edited according to this ratio, which is why Salustri Photography offer a 12×8 inch print instead of a 10×8 inch print. However, some poster enlargements and canvas sizes may incur image cropping, which will be done at my professional discretion.

9. Postage & Packaging

9.1 The post and packing charges are included on all print and canvas packages within the United Kingdom. Individual items ordered at a later date will incur an additional charge starting at £3.95 for prints.

10. Copyright

10.1. The 1998 Copyright, Designs, and Patents Act assigns copyright of all images to Salustri Photography. By purchasing images in print form you are purchasing the image, not the copyright and therefore have no rights to reproduce the image in any medium. You may not copy the photographs taken under this contact, or allow copies to be made photographically, electronically, or by any other means. This is a standard condition for professional photographers.

10.2. The client(s) agree that no photographs or videos must be taken during the photo session.

11. Post-editing

11.1 Client(s) must not under any circumstances post-edit or apply any filters to any digital images. This is in breach of The 1998 Copyright, Designs, and Patents Act.

12. Social media posts

12.1 Client(s) agree to only post unadulterated images on any social media platform. Also, client(s) must ensure that any image posted on social media be of sound quality, i.e., must not be inferior quality screenshots. Any accreditation to Salustri Photography must be accompanied with the professionally edited images that the photographer supplied you with.

13. Postponement due to adverse weather

13.1 If the photoshoot must be cancelled by the photographer due to adverse weather conditions, a new appointment will be made at the client(s) convenience. There is no time limit to rescheduling. Session fees or package fees are non-refundable.

14. Personal Accident

14.1 The photographer will do her upmost to ensure safety on location and at home shoots. All directions issued to clients will be responsibly made. Client(s) and their children must, however, follow these instructions at their own personal risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot caused by failure to comply with safety instructions.

15. Allergies

15.1 For photoshoots taken at the photographer’s home studio, please note that there is a dog present in the household. She is a non-shedding dog and hypoallergenic though and will be kept out of the studio at all times.

16. Complaints Procedure

16.1 Any complaints regarding Salustri Photography ought to be made in writing via email to paola@salustri.co.uk. The photographer will endeavour to respond to any complaint within five working days of receipt.
